Service Terms

These Service Terms (“Terms”) govern the work ThumbMastery does for its clients. ThumbMastery is operated by ThumbMastery LLC, a Delaware limited liability company (“ThumbMastery,” “we,” “us,” or “our”). “You” means the person or company we work for, and the channel you sign up with.

1When these Terms apply

Applying to work with us does not create a contract, and we are not obliged to accept any application. These Terms take effect when we approve your application and receive your first payment. By paying, you confirm you have read and agree to these Terms, and that you have the authority to agree on behalf of the channel and any company that owns it.

If we sign a separate written agreement with you (for example, for a partnership or a revenue-share arrangement), that agreement controls where it differs from these Terms. Everything it does not cover is governed by these Terms.

2What we do

We repackage videos you have already published: we identify videos that could perform better, develop new titles and thumbnails for them, run them as live tests on your channel, and measure the results in your own YouTube Analytics.

You choose one of three plans:

  • With your designers. We handle the audit, concepts, and briefs. Your design team produces the thumbnails from our briefs, and we check every final before it goes live.
  • Fully done-for-you. Everything above, plus our designers produce the thumbnails. Nothing for your team to touch.
  • Full packaging partnership. Scope, deliverables, and price are agreed separately in writing.

Each plan includes a set number of thumbnail tests and title tests per month, chosen by you before you apply. A test means one new thumbnail or one new title run live on one video. Any published video on your channel can be tested, including recent uploads.

Our service covers titles, thumbnails, testing, and results tracking. It does not include scripting, video editing, filming, channel strategy beyond packaging, or packaging new uploads before they go live, unless agreed in writing.

3How the work runs

We decide which videos to test and what to test, using our judgment and the data we see. You can tell us at any time to exclude specific videos, and we will respect that.

Tests go live without individual approval from you, so we can keep a steady cadence. If you want to approve every change before it goes live, tell us in writing and we will work that way, understanding it may reduce how many tests we complete in a month.

If a test performs worse than the original, we restore the original. If it performs better, the winning version stays live.

We report results monthly. Results are measured in your own YouTube Analytics: for each change, we compare what the video gained after the change against what it was on track to gain over the same period.

4What we need from you

  • Channel access. Access to your channel sufficient to upload titles and thumbnails, run tests, and read video performance data, usually as an editor in YouTube Studio or through a testing tool you connect. Without access, we cannot do the work, and months still count toward your plan.
  • Your designers (With your designers plan). Your team produces finals from our briefs within a reasonable time. Delays on your side do not extend the month or add tests.
  • Materials. Any photos, brand assets, or other materials we need, which you confirm you have the right to let us use.
  • Compliance. Your channel and content comply with YouTube’s terms and applicable law. You are responsible for how you use anything we deliver.

You are responsible for your channel and everything on it. We are not responsible for the actions of YouTube or Google, including changes to their platform, policies, or features.

5Fees and billing

The price for your plan is shown when you choose your volume and does not change unless you change your plan. We invoice each month in advance. A month starts on the day we receive payment and runs for 30 days. Work does not start until payment arrives.

Tests are per month and do not roll over. If tests go unused because of delays on your side, such as missing channel access, missing materials, or your designers not delivering, they expire at the end of the month. If we fail to deliver tests for reasons within our control, section 6 applies.

You can change your plan or volume for the following month by telling us before your next billing date. Changes apply from the next month.

If a payment is late, we may pause work until it is received. We will give you at least 30 days notice before any price change, and it will not apply to a month you have already paid for.

Prices exclude any taxes you are required to pay in your country.

6Cancellation and refunds

There is no minimum commitment. You can cancel at any time before your next billing date by emailing us, and you will not be billed again. Work continues until the end of the month you have paid for.

Payments are not refundable once a month has started, because our work on your channel begins immediately. If we fail to deliver the tests you paid for during a month for reasons within our control, we will complete them in the following month or refund the undelivered portion, at your choice.

We can end our work together at any time with 30 days written notice. We can end it immediately if you breach these Terms, if we lose access to your channel and it is not restored within 14 days, or if we are required to by law.

When our work ends, we remove ourselves from your channel. Titles and thumbnails that are live at that time stay live. You are free to keep, change, or replace them.

7Results

We do not guarantee specific results. YouTube performance depends on many factors outside our control, including the platform’s algorithms, your content, and your audience. What we commit to is the process: every change runs as a measured test, and you see the numbers.

Case studies and figures on our website reflect past results for specific channels and are not a promise of what your channel will achieve.

8Ownership

Your content stays yours. Your videos, channel, brand, and any materials you give us remain your property. You give us a license to use them only to do the work you hired us for.

Deliverables are yours once paid for. Every final title and thumbnail we deliver during a paid month becomes your property when that month is paid in full. You can use it however you like.

Our methods stay ours. We keep all rights to our processes, templates, testing methods, know-how, and any concepts, drafts, or variants that were not delivered as finals. We may use them for other clients.

Thumbnails may include AI-generated and third-party elements. We use AI image tools and licensed assets in our work. We do not warrant that AI-generated elements are unique or protectable, and you are responsible for how you use the finals on your platforms.

9Showing our work

We may show completed work in our portfolio, on our website, and on our social media, including the titles and thumbnails we produced, your channel name, and view performance of the kind already visible on YouTube.

We will not publish without your written permission: revenue or RPM data, private analytics, unpublished or unreleased concepts, variants that lost a test, our internal communications with you, or anything you tell us in writing is confidential.

You can opt out at any time by emailing us. We will stop featuring your work in new material and remove it from our website and social media within 14 days. Opting out does not apply to material published before we received your request.

10Confidentiality

Each of us keeps the other’s non-public information confidential and uses it only for the work together. This includes your channel data and our methods and pricing. It does not include information that is public, that either of us already knew, or that must be disclosed by law.

Any designers or contractors we bring in are bound by the same obligations.

This section continues to apply for two years after our work ends.

11Third-party tools

We use third-party tools to run tests and track results, including YouTube and testing tools. We may also use Feedzy, a workspace operated by ThumbMastery LLC, to organize our work. We are not responsible for the availability, changes, or actions of third-party platforms, including YouTube, and delays caused by them do not count as a breach of these Terms.

12Liability

We do our work with reasonable skill and care. To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential losses, including lost revenue or profits, or for any loss of views or subscribers.

Our total liability for any claim relating to our work or these Terms is limited to the fees you paid us in the three months before the claim arose.

You agree to cover any claims against us that arise from your content, your channel, or your breach of these Terms.

13Changes to these Terms

We may update these Terms from time to time. We will email current clients at least 30 days before material changes take effect. Changes do not apply to a month you have already paid for. If you do not agree with updated Terms, you can cancel before they take effect.

14Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law rules. Any dispute will be resolved in the courts of the State of Delaware. Before either of us starts legal proceedings, we agree to try to resolve the dispute by discussion in good faith for 30 days.

15General

If any part of these Terms cannot be enforced, the rest still applies. These Terms, together with our Privacy Policy and any written agreement between us, are the entire agreement about our work. Neither of us may transfer this agreement to someone else without the other’s consent, except that we may transfer it to a company that acquires our business, provided it honors these Terms.
